General Conditions and Privacy policy for Runners

1.1 BikeRunner is an online platform that provides mediation of a bike puncture repair and related tasks between a freelance person (“Runner” or “Freelancer”) and platform users (“Customer”).

1.2 A person applies to become a Runner undergoes an authentication process. If the Runner is approved, the Runner will receive some guidelines on how BikeRunners mediated tasks should be solved.

1.3 Customers can book jobs that may include bicycle puncture repairs. The prices are pre-set for all services available on BikeRunner.

1.4 When a task is communicated through BikeRunner, the selected Runner independently coordinates the types of tasks to be solved as asked and communicates back to BikeRunner and the customer when it can be solved. BikeRunner support can be used as an intermediary for further communication with the customer if needed.

1.5 The Freelancer understand that they as a freelancer are responsible for the quality of their work, and that it is their responsibility to acquire the competences and tools needed to perform the job. The Runner is free, and even encouraged, to deny performing a task at any point (also after accepting it), if the Runner deems the job too complicated for their competence.

1.6 If BikeRunner is not able to get payed from the customer, the Runner cannot be payed either. If BikeRunner deems it as mandatory to repay/compensate a customer because of a job badly done, the Runner is economically responsible for this – and if payment is not done – the Runner might be obliged to perform future tasks without payment.

 

  1. Collaboration between Freelancer and BikeRunner

 

2.1 Freelancer must be approved to be established as a Runner in the Platform. Freelancer applies for approval through ensuring that all information asked for is delivered correctly, truthfully and on time.

2.2 Freelancer can assume mediated tasks when Freelancer has met the requirements set by BikeRunner in the application process.

2.3 Working hours may vary from week to week according to what the Freelancer communicates to BikeRunner. BikeRunner does not guarantee a certain number of hours or tasks. Tasks are sent out to all available Runners matched with the customers address, and the first Runner to accept that is able to perform the task within deadline will be appointed the task.

2.4 The Runner is required to keep his availability and contact information updated at all times. The Runner is free to abort or pause the collaboration at any time, although doing so does not free him of responsibility for tasks already performed.

2.5 The Freelancer agrees for BikeRunner to contact them through phone and email during any time about a task, unless otherwise is agreed upon.

2.6 The Freelancer will recieve both an email and a text message when a task is available for him/her. The Freelancer understands that if they continually don’t answer accept/not accept on task requests, BikeRunner is free to delete them from the force of Runners after a final warning has been sent on email with a deadline for reply.

2.7 The Freelancer understands that if they are not able to fix the task within the current timeframe set from BikeRunner (order time until fixed bike), the task might be passed on to another Runner. The Freelancer also understands that if the Runner themselves, or BikeRunner, deems the Runner unable to perform the task based on competences – then BikeRunner is free to pass the task on to another Runner.

2.8 The Freelancer understands that BikeRunner keeps an internal rating system whilst running the pilot project, and if a Runner fails to comply any of the general conditions written here – this will influence the number of tasks the Runner are likely to get.

2.9 If the Freelancer choose to abort the collaboration with BikeRunner, the Runner is obliged to return merchandise given to them by BikeRunner (such as saddle covers, stickers, balloons etc.)

 

  1. Settlement

 

3.1 Freelancer cannot determine his own price for services rendered. A Runner can ask for additional compensation if the job highly differs from the job as described on the website but is required to notify BikeRunner and the customer of such requests before service is started. The job cannot be performed to another price than shown on the order unless it is pre-approved by BikeRunner and customer.

3.2 If Freelancer has earned more than 50,000 DKK in 12 consecutive months, Freelancer is obliged to make BikeRunner ApS aware of this and to register for VAT.

3.3 Customers pay for the service through BikeRunner, that sends an invoice to the customer after service in rendered and approved by customer. In cases where the customer is not able to pay through the payment process set up by BikeRunner, the Runner can receive the money from the customer and afterwards forward the 15% commission of the total price to BikeRunner. BikeRunner should always be pre-notified by such conditions by the Runner.

3.4 The total payment after deduction of the BikeRunners commission will be paid through MobilePay on the number provided by the Freelancer. BikeRunner strives to pay the Runner as soon as possible and will strive to at a minimum do payments once a week. If these deadlines cannot be met, Runners will be notified. BikeRunner cannot be held responsible for late payment by the customer, but will shoulder the responsibility of collecting the money owed by the customer with relevant means, also on the Runners behalf.

3.5 BikeRunners Commission is pt. 15%. All rates are inclusive of VAT.

3.6 Freelancer is required under Danish law to report remuneration as B income to SKAT. The Runner is also able to report task-related expenses to SKAT, which can be deducted.

3.7 The Freelancer gives his/her consent to BikeRunner to invoice the customer and to maintain the payment in the company until it can be paid out at the earliest convenience to the Freelancer.

 

  1. Expenses

 

4.1 If/when Freelancers work involves tools, spare parts, travel and so forth, Freelancer carries all necessary expenses. These expenses can be deducted in tax.

 

  1. Illness and vacation

 

5.1 The freelancer himself / herself incur expenses for absence due to illness and holiday.

5.2 Freelancer is required as soon as possible to announce to BikeRunner if he/she has turned ill and therefore cannot conduct a task that he/she has already accepted.

 

  1. Other duties

 

6.1 Freelancers can have other duties besides BikeRunner – such as other jobs, studies etc.

 

  1. Confidentiality and Privacy policy

 

7.1 Freelancer may not transfer or use or allow others to use BikeRunners trade secrets or other information about BikeRunner or it’s customers, regardless of the nature that is not publicly available.

7.2 Freelancer may not acquire or attempt to acquire knowledge of or availability of BikeRunners confidential information as described in Section 7.1. Freelancer must be circumvented and keep the information safe to prevent them from accidentally coming to the knowledge of third parties.

7.3 Freelancers must deliver BikeRunners confidential information as described in Section 7.1 to BikeRunner as soon as the collaboration is interrupted and may not keep a copy of the information.

7.4 Freelancers’ obligations under sections 7.1-7.3 apply both during the cooperation and at any time after the end of the cooperation.

7.5 The Runner agrees to that BikeRunner, during the time the Freelancer stands open to receiving tasks from Bikerunner, upholds the contact information of the Runner such as Name, address, email, phone number and communications and task history and ratings. The Runner can at any time ask to see any records upheld by BikeRunner on the Freelancer.

 

  1. Duration

 

8.1 BikeRunner may revoke Freelancers’ approval at any time without notice and terminate this Cooperation Agreement.

8.2 Freelancer may terminate this Collaborative Agreement and terminate their job for BikeRunner.

 

  1. Other terms

 

9.1 The cooperation relationship is not governed by collective agreements or agreements.

9.2 If there is a disagreement between Freelancer and BikeRunner, which they cannot solve in simplicity, the disagreement at Copenhagen City Council is determined.

10. App terms and permissions

10.1 All information collected by the app is stored on a secure server

10.2 All runner profile data will be removed on request. Simply write an e-mail to contact@bikerunner.dk if you want to be completely deleted

10.3 When “Express orders” are activated in the App settings page, the app will track the runners location for as long as “Express orders” are active. As soon as runner inactivates “Express orders” the app will stop tracking the runners location. Location are tracked in the background and runners location are continuously sent to the bikerunner server in order for customers to send express orders to the runner. Please note that this location tracking also happens when the app is closed, but can be switched off at any time by deactivating “Express orders” in the settings page.
